Probate

Probate is the court’s way of ensuring the proper transfer of property to the next generation. If someone in your family has passed away without leaving everything they owned in a trust, you will need to take care of their estate by affidavit or through probate.

In estates worth less than $100,000, Utah will allow the distribution of personal or intangible property by affidavit. This process is simple and inexpensive. If you need help with this, feel free to ask us.

In larger estates, or any estate containing real property, you must go through the probate process. This process can be formal or informal:

Informal probate is shorter and more simple (and therefore less expensive) than formal probate. Informal probate must be started within 3 years of death. There are other requirements, but the timeline is the most important one. We can help you with the informal probate process for a flat fee.

Formal probate can take several months or longer, but it is sometimes necessary. If you need formal probate, please let us guide you through the process.
